Terms & Conditions
This agreement contains the terms and conditions that apply to your purchase from Primal Fitness Systems, LLC entity named on the invoice that will be provided to you, the Customer, on orders for products sold. These terms and conditions are subject to change without prior notice at any time at Primal Fitness Systems, LLC’s sole discretion.
These terms and conditions may NOT be altered, supplemented or amended to the use of other documents. Any attempt to alter, amend or supplement this document will void this agreement.
This agreement and any sales there under shall be governed by the laws of the state of Kentucky without conflicts of laws ruled.
All purchases are made by credit card. No cash, check or wire transfer is accepted. Purchases will be shipped only when credit card charges have been processed and accepted.
Shipping and handling and taxes will be charged separate from the purchased product with credit card. The Customer is responsible for sales tax and all other taxes associated with the order, except for Primal Fitness Systems, LLC’s net income tax. Sales tax can only be exempt when the customer provides a valid tax exempt certificate applicable to the product.
Title to product passes from Primal Fitness Systems, LLC to Customer at time of shipment. Loss or damage that occurs during shipping by carrier becomes the Customer’s responsibility.
Returns are provided on the invoice and are only applicable to the Customer who directly purchased the product and not a third party.
Primal Fitness Systems, LLC does not accept liability for any misuse of any product outside of the guide lines provided with that particular product. Primal Fitness Systems, LLC will not be liable, for any reason, for personal/bodily or property damage, loss of business, punitive damages or for any claim by a third party.
The customer expressly agrees that the foregoing agreement and releasall
claims are intended to be as broad and inclusive as is permitted by the law of Kentucky. The customer is responsible for reading all literature provided with all products and assumes all risks and release, waive, discharge, harmless indemnify and covent not to sue Primal Fitness Systems, LLC, it’s board, employees, volunteers, coaches and trainers.
By ordering and paying for any product sold by Primal Fitness Systems, LLC Customer agrees to and is bound by all of the terms set forth by the Terms and Conditions of Sale.
